Abstract

Debt and receivable agreements often cause problems that cannot be resolved using ordinary civil law, so the government makes regulations regarding Bankruptcy and PKPU. PKPU is an effort to restructure debtors' debts so that they do not enter general confiscation. The granting of Fixed PKPU must be based on a predetermined quorum. The author wants to know what is the basis for the judge's consideration in deciding the case in the decision and the legal consequences for concurrent creditors in the decision. The research results show that the Panel of Judges granted a Permanent PKPU not based on the quorum that had been arranged and that concurrent creditors received payment of their receivables last after other types of creditors.
